By downloading, accessing, browsing, or using Noewa, you agree to be bound by these Terms and Conditions. These Terms form a legally binding agreement between you and Noewa regarding your use of the application, its features, and related services.
If you do not agree to these Terms, you must not use the app. Your continued use of Noewa after any update to these Terms will constitute your acceptance of the revised version.
To the maximum extent permitted by applicable law, Noewa and its operators, affiliates, licensors, service providers, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the app. This includes, without limitation, damages for lost data, lost profits, loss of goodwill, emotional distress, device failure, or interruption of business or personal activities.
Where liability cannot be excluded entirely, it will be limited to the minimum amount permitted by law.
Subject to your compliance with these Terms, Noewa grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the app solely for your own non-commercial purposes. This license allows you to access the app’s mood tracking, breathing guidance, journaling, calendar, report, and related result-card features only as made available by Noewa.
You may not rent, lease, sell, redistribute, assign, or otherwise exploit the app except as expressly authorized in writing.
Noewa is provided on an “as available” and “as offered” basis. We do not guarantee that the app, any feature, or any generated result will be available at all times, free from delay, secure, or error-free.
We may, at any time and without prior notice, modify, restrict, suspend, discontinue, or remove any part of the service, including features, templates, sample directions, virtual currency mechanisms, or access to historical content, whether for maintenance, legal, security, operational, or business reasons.
You must be at least 17 years old to use Noewa. By using the app, you represent and warrant that you meet this minimum age requirement and that you have the legal capacity to enter into a binding agreement under the laws applicable to you.
If you do not satisfy these requirements, you are not permitted to use the service.
You agree to defend, indemnify, and hold harmless Noewa and its operators, affiliates, licensors, contractors, employees, and agents from and against any claims, demands, actions, liabilities, losses, damages, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to: (a) your use or misuse of the app; (b) your violation of these Terms; (c) your breach of any law or third-party right; or (d) any content, material, image, text, sticker, journal entry, or other information you submit, upload, generate, share, or distribute through the service.
We reserve the right to suspend, limit, or terminate your access to Noewa at any time, with or without notice, if we believe you have violated these Terms, created legal risk, engaged in misuse, or if discontinuation is necessary for operational or legal reasons.
You may stop using the app at any time. Termination or discontinuation of access does not affect any rights or obligations that by their nature should survive, including provisions relating to liability limitations, indemnification, intellectual property, and governing law.
You agree not to use Noewa in any unlawful, abusive, harmful, or unauthorized manner. Prohibited conduct includes, but is not limited to: violating applicable laws or regulations; infringing another person’s intellectual property, privacy, publicity, or other rights; uploading or sharing content that is defamatory, obscene, fraudulent, threatening, hateful, or otherwise objectionable; using the app to harass, exploit, or harm others; or attempting to use the service for medical diagnosis or emergency response.
You also may not reverse engineer, decompile, disassemble, scrape, mirror, copy, frame, or derive source code from the app except where such restriction is prohibited by law. In addition, you may not use bots, scripts, automation tools, crawlers, or similar means to access or manipulate the service; interfere with servers, networks, or security features; bypass usage restrictions; introduce malware or harmful code; or attempt unauthorized access to accounts, systems, or data.
Noewa may offer consumable virtual currency, including coins, through Apple in-app purchases. Coins may be used within the app for eligible features or generation-related functions as described at the time of purchase.
Coins are licensed, not sold; they have no cash value, are not redeemable for money, are not transferable, and may not be resold or exchanged outside the app. Except where required by applicable law or Apple’s mandatory policies, purchases are final and non-refundable. We may change coin pricing, availability, usage rules, or related features at any time.
Noewa is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, quiet enjoyment, accuracy, and reliability.
We do not warrant that the service will meet your expectations, that the app will always function without interruption or error, or that defects will be corrected.
Noewa provides automated outputs such as mood timelines, emotion calendars, trigger rankings, breathing practice statistics, monthly emotion reports, cycle-related views, result cards, and similar content generated from your inputs and app logic. These outputs are for personal informational, reflective, and organizational purposes only.
Generated results may be incomplete, generalized, inaccurate, outdated, or not suitable for your particular circumstances. They are not medical, psychological, psychiatric, therapeutic, legal, or professional advice, and they should not be relied upon as a substitute for qualified care or judgment. Any reliance on generated results is at your own risk.
Noewa is an AI-enabled mood journaling and breathing guidance application centered on an “emotion garden” and mood management experience. The service is designed to help users record emotional labels, intensity, triggers, brief reflections, breathing practice records, and reminder times, with optional photos or stickers, while allowing core entries to be completed without images.
Based on user inputs, Noewa may present structured outputs such as emotion timelines, emotion calendars, trigger rankings, breathing practice statistics, monthly mood reports, cycle-related views, and a local library of emotional self-help content. The app emphasizes lightweight, result-oriented expression rather than open-ended creation tools, and may provide reusable visual result cards, share-ready summaries, history review, re-entry into prior workflows, and actions such as save, share, copy, delete, or render again.
The product experience is organized around fixed themes, templates, and guided directions rather than a broad general-purpose creation platform. Available examples and features may include mood check-ins, gratitude notes, breathing cards, journal pauses, and similar structured formats intended to support sustainable self-care and reflection. Noewa is not presented as a social community feed, a cross-device synchronization platform, or a clinical mental health service.
You are solely responsible for the content and information you provide to Noewa, including text entries, emotional labels, photos, stickers, reminders, and any material you save or share from the app. You represent that you have all necessary rights, permissions, and lawful authority to submit such content.
You are also responsible for how you interpret and use any outputs provided by the service, for maintaining the security of your device and account environment, and for ensuring that your use of the app complies with applicable law and these Terms.
Noewa, including its software, design, visual interface, templates, branding, text, graphics, features, functionality, and all related intellectual property rights, is owned by Noewa and/or its licensors and is protected by applicable copyright, trademark, trade secret, and other laws.
Except for the limited license expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, distribute, publicly display, create derivative works from, or otherwise exploit any part of the app except as permitted by applicable law or with prior written authorization.
We may revise or update these Terms from time to time to reflect changes in the service, legal requirements, billing practices, or business operations. When we do, we may update the effective date above and make the revised Terms available through the app or other reasonable means.
Your continued use of Noewa after updated Terms become effective means that you accept the revised agreement. If you do not agree to the changes, you must discontinue use of the service.
You retain ownership of the content you upload, submit, or create through Noewa, including photos, journal entries, mood records, and similar personal material. Noewa does not claim ownership of your user content.
However, by submitting content through the app, you grant Noewa a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, format, analyze, reproduce, and display that content solely as necessary to operate the service for you, including generating result cards, reports, visual summaries, and related app functions. This license lasts only for as long as reasonably necessary to provide the service and fulfill operational, security, backup, legal, or compliance purposes.
These Terms and your use of Noewa shall be governed by and construed in accordance with the applicable laws of the jurisdiction determined under relevant law, without regard to conflict of law principles, except to the extent such principles are mandatorily applied.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
